Terms of Use — DynaWatch

1. Description of the App

DynaWatch is a third-party mobile client for Dynatrace monitoring environments. The App allows you to view and manage Dynatrace problems, browse monitored entities, build custom metric dashboards, receive notifications about Dynatrace problems, and view problem data via Home Screen widgets.

DynaWatch is an independent product and is not affiliated with, endorsed by, or sponsored by Dynatrace LLC or its affiliates.

2. Requirements

To use the App, you need:

• An iOS device running iOS 17.0 or later.
• A valid Dynatrace environment (SaaS or Managed) with an API access token.
• An active internet connection to communicate with the Dynatrace API.

3. Your Dynatrace Account

The App connects to your Dynatrace environment using an API token that you provide. You are responsible for:

• Ensuring your API token has appropriate scopes and permissions.
• Keeping your API token confidential and secure.
• Complying with your organization's Dynatrace usage policies.
• Any actions performed through the App on your Dynatrace environment (such as acknowledging or closing problems).

We do not have access to your Dynatrace environment, API token, or monitoring data.

4. Subscription and Payment

DynaWatch is free to download and use with core features. Advanced features require an active DynaWatch Pro subscription. All purchases are processed by Apple through the App Store and are subject to Apple's terms and refund policies.

• A 7-day free trial is provided automatically on first install — no payment method required.
• Subscription plans are available on a monthly or annual basis.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Apple ID settings.
• Refund requests must be directed to Apple.

5. Acceptable Use

You agree to:

• Use the App only for its intended purpose of monitoring Dynatrace environments.
• Not reverse engineer, decompile, or disassemble the App.
• Not use the App to violate any applicable laws or regulations.
• Not attempt to interfere with the operation of the DynaWatch push server or its infrastructure.

6. Push Notification Service

The DynaWatch push notification server is provided as an optional feature for delivering real-time problem notifications. By enabling push notifications, you agree that:

• Dynatrace problem data (problem title, severity, impacted entities) will be transmitted through the DynaWatch push server for notification delivery.
• Problem data in transit is used only to compose notifications and is not stored beyond delivery logs.
• The push service is provided on a best-effort basis and may experience downtime for maintenance or unforeseen issues.

7. Intellectual Property

The App, including its design, code, graphics, and documentation, is the intellectual property of NexoLab Igor Barkowski and is protected by copyright law. All rights not expressly granted in these Terms are reserved.

Dynatrace is a trademark of Dynatrace LLC. All other trademarks are the property of their respective owners.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• The App will be compatible with all Dynatrace environments or configurations.
• Push notifications will be delivered in real time or without delay.
• Data displayed in the App will be accurate, complete, or current — data accuracy depends on the Dynatrace API.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEXOLAB IGOR BARKOWSKI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO MISSED OR DELAYED NOTIFICATIONS, ACTIONS TAKEN BASED ON INFORMATION IN THE APP, LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITIES, OR UNAUTHORIZED ACCESS TO YOUR DYNATRACE ENVIRONMENT.

Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless NexoLab Igor Barkowski from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

11. Third-Party Services

The App interacts with third-party services governed by their own terms:

• Dynatrace — your use of Dynatrace is subject to your agreement with Dynatrace LLC.
• Apple — your use of the App Store, iCloud, and Apple Push Notification service is subject to Apple's terms and conditions.

We are not responsible for the availability, accuracy, or conduct of any third-party services.

12. Termination

We may discontinue the App or the push notification service at any time. You may stop using the App at any time by uninstalling it. Upon termination, your local data is removed when you uninstall the App, and push notification registrations are deleted when you disable push or unregister your device.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law provisions.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. The "Last updated" date at the top reflects the most recent revision.
